These Terms of Service ("Terms") govern your access to and use of drinkholacalm.com and your purchase of Hola Calm products. The website and store are operated by Dynamic Nexus, LLC ("Hola Calm," "we," "us," or "our"). By visiting the site, placing an order, or using our services, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund Policy.

1. Eligibility and acceptable use

You must be at least the age of majority in your state of residence to make a purchase. You may not use the site or products for any unlawful purpose, interfere with the site's security or operation, introduce malicious code, scrape or copy content without permission, or violate the rights of others.

2. Product information and wellness disclaimer

We work to present product descriptions, ingredients, images, prices, and availability accurately, but minor differences or errors may occur. Product packaging and information should be reviewed before use.

Statements about Hola Calm products have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. All prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping charges, discounts, and the final order total are shown at checkout. We may correct pricing or product information errors and may limit, reject, or cancel orders, including orders that appear fraudulent, unauthorized, or intended for resale. If we cancel an order after payment, we will refund the amount charged.

You represent that the billing, payment, contact, and shipping information you provide is current, complete, and accurate and that you are authorized to use the selected payment method.

4. Free Trial offers

Hola Calm Free Trial offers are one-time promotional purchases and do not create a subscription unless the offer page and checkout expressly state otherwise. The 4-Night Free Trial includes free product and a $3.99 shipping charge. Current pricing and shipping for 7-Night and 11-Night trials are shown on the offer page and confirmed at checkout. Trial availability, limits, and eligibility may change, and we may limit trial quantities per customer, household, address, or payment method.

5. Shipping, returns, and refunds

Orders are subject to our Shipping Policy and Refund Policy, which are incorporated into these Terms. At present, online orders are shipped only to eligible addresses in the United States.

6. Intellectual property

The site and its content, including the Hola Calm name, logos, product names, graphics, photographs, text, videos, designs, and software, are owned by or licensed to us and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, revocable right to use the site for lawful shopping and informational purposes. No content may be reproduced, distributed, modified, sold, or commercially exploited without our written permission.

7. Reviews and user content

If you submit a review, photo, comment, or other content, you confirm that it is truthful, based on your own experience, and does not violate any law or third-party right. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, and display that content in connection with our business and marketing. We may remove content that is unlawful, misleading, abusive, promotional, or unrelated.

Our store is hosted by Shopify and may use third-party payment, analytics, advertising, fulfillment, and technology providers. Third-party services and websites are governed by their own terms and privacy policies. We are not responsible for third-party content, availability, or practices.

We do not guarantee uninterrupted or error-free access, that all information will always be complete or current, or that a product will produce a particular result. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

10. Limitation of liability

To the fullest extent permitted by law, Dynamic Nexus, LLC and its affiliates, officers, employees, agents, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, data, or opportunities arising from the site, services, or products. Our total liability for a claim related to an order will not exceed the amount you paid for that order. These limits do not apply where prohibited by law.

11. Indemnification

You agree to indemnify and hold harmless Dynamic Nexus, LLC and its affiliates, officers, employees, and agents from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the site, your violation of these Terms, or your infringement of another person's rights.

12. Governing law and severability

These Terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law principles. If any provision is found unenforceable, the remaining provisions will continue in effect.
